Terms of Service

Welcome to PayUpGolf! These Terms of Service ("Terms") govern your use of the PayUpGolf mobile application ("App") operated by PayUpGolf ("we," "us," or "our"). By using our App, you agree to these Terms.
1. Acceptance of Terms
By downloading, accessing, or using PayUpGolf, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Eligibility
You must be at least 18 years old to use PayUpGolf. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
3. Account Registration
To use certain features of the App, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Description of Service
PayUpGolf is a golf scorecard and social betting game tracker that allows users to:
- Track golf scores during rounds
- Play traditional golf betting games (Skins, Nassau, Animals, etc.)
- Calculate and track settlements between playing partners
- Connect with friends and share round information
- View round history and statistics
Important: PayUpGolf is a scorecard and record-keeping tool only. We do not facilitate, process, or hold any money. All financial settlements between users occur outside of the App and are solely between the users involved.
5. Betting Games & Financial Settlements
By using PayUpGolf's betting game features, you understand and agree that:
- Social Wagering Only: The App is designed for friendly, social wagering between people who know each other personally.
- No Money Handling: PayUpGolf does not collect, hold, transfer, or process any money or payments. We simply track and calculate what players may owe each other.
- User Responsibility: You are solely responsible for any bets you make and any settlements you arrange with other players.
- Legal Compliance: You are responsible for ensuring that your use of betting game features complies with all applicable local, state, and federal laws in your jurisdiction.
- No Guarantee of Payment: We do not guarantee that other users will honor their betting commitments. Settlement of bets is entirely between users.
6. Veteran Benefits
PayUpGolf offers lifetime premium access to verified United States military veterans. Veteran status is verified through ID.me. We reserve the right to revoke premium access if verification is found to be fraudulent.
7. Acceptable Use
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Use the App for commercial gambling operations
- Impersonate any person or entity
- Interfere with or disrupt the App or servers
- Attempt to gain unauthorized access to any part of the App
- Use the App to harass, abuse, or harm others
- Create multiple accounts to abuse features or promotions
8. Intellectual Property
The App, including its design, features, content, and trademarks, is owned by PayUpGolf and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
9. User Content
You retain ownership of content you create (scores, notes, etc.). By using the App, you grant us a license to use, store, and display your content as necessary to provide our services.
10. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
- The App will be available at all times
- The App will be error-free or secure
- Results or calculations will be accurate
- Course information will be current or correct
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYUPGOLF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of money from bets or settlements
- Disputes between users over betting outcomes
- Errors in score tracking or calculations
- Loss of data or account access
- Any damages arising from your use of the App
12. Indemnification
You agree to indemnify and hold harmless PayUpGolf, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of another.
13. Termination
We may suspend or terminate your access to the App at any time, for any reason, without notice. You may delete your account at any time. Upon termination, your right to use the App ceases immediately.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Michigan.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
